While there is currently no existing federal law that prohibits hair discrimination, there have been legislative proposals to do so. In the last few years, multiple states and local governments have passed laws that prohibit such discrimination, California being the first state to do so in 2019 with the Crown Act.

The CROWN (Create a Respectful and Open Workplace for Natural Hair) Act (SB 188) is a California law which prohibits discrimination based on hair style and hair texture by extending protection for both categories under the FEHA and the California Education Code. It is the first legislation passed at the state level in the United States to prohibit such discrimination.

While all women experience pressure to conform to certain standards of appearance, society’s bias has resulted in unfair judgment and discrimination against Black women based on hair texture and protective hairstyles, including braids, locs, and twists, that are inherent to their race. This means, Black women can be denied opportunities for employment or professional advancement without consequence.
