We Know Hazardous Waste Pollution Laws

Matern Law Group, PC is an environmental law firm with locations throughout California.

Environmental rights are an extension of the basic human rights that mankind requires and deserves. In addition to having the right to food, clean water, suitable shelter, and education, having a safe and sustainable environment is as critical as any of these other rights. California’s environmental laws are enforced by both state and local agencies, each charged with enforcing the laws governing specific types of environmental pollution.

California has unique hazardous waste regulations that include, but substantially exceed requirements of the federal Resource Conservation and Recovery Act (RCRA) regulations generally in effect in other states. It is also hard to navigate California’s hazardous waste requirements because of the dramatic differences in substantive requirements, enforced by pervasive local city and county agencies deputized as Certified Unified Program Agencies (CUPAs) and result in surprising violations and onerous penalties.

Common categories of hazardous waste materials are:

  • Lights, Batteries & Electronics (i.e, common batteries, car batteries, monitors)
  • Mercury-Containing Items (i.e, mercury switches, thermostats, pilot light sensors)
  • Household & Landscape Chemicals (i.e, pool chemicals, acids, oxidizers, pesticides, herbicides)
  • Paints & Solvents (i.e., latex paint, oil-based paint, aerosol paint, solvents, paint thinners)
  • Building Materials (i.e., asbestos, treated wood)
  • Automobile-Related (i.e., antifreeze, batteries, motor oil and filters)
  • Other Materials (i.e, propane tanks, needles & syringes, ballasts, photo waste, flammables)

If you have had your health harmed or well-being damaged by any type of hazardous waste or contamination, or have witnessed illegal hazardous waste pollution, dumping, or disposal, you may have a legal claim.
