The attorneys at Matern Law Group have extensive experience protecting consumers from unfair, deceptive, fraudulent, and predatory business practices.
California has some of the nation’s strongest consumer protection laws. Depending on the circumstances, consumers may have rights under laws such as California’s Unfair Competition Law (UCL), Consumers Legal Remedies Act (CLRA), False Advertising Law (FAL), and other state and federal statutes. These laws can prohibit businesses from using deceptive advertising, misleading representations, unfair practices, and other unlawful tactics to obtain money from consumers.
Consumer fraud can take many forms. For example, altering a vehicle’s odometer to falsely represent its mileage can violate state and federal law. Other deceptive practices may involve hidden fees, false advertising, misleading product claims, unauthorized charges, or misrepresentations about goods and services.
Consumers harmed by unlawful business practices may have legal remedies depending on the law involved and the circumstances of their claims. A Palo Alto consumer protection lawyer can evaluate the conduct, explain the laws that may apply, and help determine whether an individual lawsuit, class action, or other legal remedy may be appropriate.
California insurance companies owe important duties to their policyholders and must handle covered claims in good faith. An insurer may act in bad faith when it unreasonably denies benefits, delays payment, fails to adequately investigate a claim, or otherwise fails to fulfill its obligations to an insured.
When an insurance company’s policies or practices affect numerous policyholders in a similar manner, the conduct may potentially result in class actions or other coordinated litigation, depending on the nature of the claims.
California consumers are protected against many forms of false and misleading advertising. California’s False Advertising Law, Unfair Competition Law, and Consumers Legal Remedies Act can apply to deceptive representations about products, services, prices, characteristics, benefits, or other material information.
Deceptive marketing may include misleading advertisements, false product claims, undisclosed fees, deceptive pricing practices, misleading environmental claims, or material information omitted in a manner that misleads consumers.
Consumers who suffer harm because of deceptive marketing may have legal remedies under California or federal law, depending on the circumstances.
“Greenwashing” occurs when a business makes false, misleading, or inadequately supported environmental claims about its products, services, or business practices.
Companies may engage in greenwashing by exaggerating a product’s environmental benefits, using misleading sustainability labels, making unsupported claims about recyclability or carbon emissions, or creating a false impression that a product is more environmentally responsible than it actually is.
Depending on the circumstances, misleading environmental marketing may violate California’s consumer protection and false advertising laws as well as applicable federal requirements.
Consumers should be able to rely on accurate information when deciding which products to purchase and use. False or misleading labels can conceal important information about a product’s ingredients, characteristics, quantity, origin, safety, effectiveness, or other material qualities.
California and federal laws regulate various forms of product labeling and advertising. Depending on the circumstances, manufacturers, distributors, retailers, or other businesses may face liability when inaccurate or misleading representations cause consumer harm.
When the same labeling or marketing practice affects many consumers, a class action may provide a way to address common claims collectively.
