What Is Air Pollution?

Air pollution involves gases, particles, or other substances in the air that can harm human health or the environment. What Laws Address Air Pollution in California?

Depending on the circumstances, pollution affecting a person’s property may also raise a private nuisance claim. California’s private nuisance framework requires proof of substantial interference with property use or enjoyment, legally actionable conduct, harm, causation, and other applicable elements.

• Industrial chemical releases: A facility releases fumes that allegedly cause documented injuries or interfere with nearby residents’ use of their homes.

Does Exposure Automatically Establish a Claim?

No. Living near a facility, noticing an odor, or developing a health condition does not alone establish liability. A legal review may examine the pollutant, source, timing, duration, applicable standards, responsible parties, and connection between the conduct and alleged harm. Technical or medical evidence may be necessary.

What Can You Document or Report?

Keep a dated log of incidents, locations, odors or visible emissions, and effects on property use. Preserve photographs taken safely, agency correspondence, relevant medical records, and expense receipts. For complaints involving a stationary facility, California’s Air Resources Board directs residents to the appropriate local air district.
