California’s Parental Leave Laws: A Guide for New and Expecting Parents

California Parental Leave LawyersCalifornia boasts some of the most comprehensive parental leave laws in the United States. This guide is designed to provide new and expecting parents with a clear understanding of their rights and available programs.

California’s Parental Leave Programs

  • California Family Rights Act (CFRA): Available to employees working for companies with five or more employees, employees who have worked for their employer for at least 12 months and worked at least 1,250 hours receive up to 12 weeks of unpaid leave under CFRA. Employees are allowed to keep and utilize their healthcare benefits from the employer during this time period. An eligible employee may take job-protected leave to bond with a new child by birth, adoption, or foster care placement within one year of the child’s birth, adoption, or foster placement, among other qualifying reasons.
  • California Pregnancy Disability Leave (PDL): Available to employees working for companies with five or more employees, PDL offers pregnant people up to four months of unpaid leave for pregnancy-related disabilities. Employees are allowed to keep and utilize their healthcare benefits from the employer during this time period. The child’s other parent is not eligible for PDL.
  • Paid Family Leave (PFL): California’s PFL program provides partial wage replacement to qualifying employees who take leave to care for a new child, among other qualifying reasons. This program is available to both parents and can be used concurrently with CFRA and/or PDL leave, offering financial support during the bonding period.
