Scott Ashford Brooks, Associate Attorney

Biography:

Mr. Brooks represents employees in all aspects of employment litigation.  He has experience with single-plaintiff, class action and representative lawsuits in state and federal courts. Mr. Brooks has handled wage and hour class and representative actions against some of the nation’s largest retailers involving claims relating to unlawful wage practices, failure to pay minimum and overtime wages, meal and rest break violations, failure to reimburse expenses, and improper wage statements.  He has represented employees in misclassification (independent contractor), unlawful harassment and wrongful termination claims. Mr. Brooks has also successfully represented consumers in Unfair Competition Law and consumer product cases.  These cases resulted in the recovery of tens of millions of dollars for employees and consumers.

Mr. Brooks has extensive experience in the appellate courts and has handled over 50 appellate matters, most of which as the primary appellate counsel for briefing and argument, including in the Supreme Court of California.  Reported cases in which he served as the plaintiff’s and/or class counsel include Sav-On Drug Stores, Inc. v. Superior Court (2004) 34 Cal.4th 319, Prachasaisoradej v. Ralphs Grocery Co., Inc. (2007) 42 Cal.4th 217, Heyen v. Safeway, Inc., et al. (2013) 216 Cal.App.4th 795, Puerto v. Superior Court (2008) 158 Cal.App.4th 1242, Harper v. 24 Hour Fitness, Inc. (2008) 167 Cal.App.4th 966, Ralphs Grocery Co. v. Superior Court (2004) 112 Cal.App.4th 1090, Lopez v. Baca (2002) 98 Cal.App.4th 1008, and Stuart v. RadioShack Corp. 641 F.Supp.2d 901 (N.D. Cal. 2009).
